Interpretations

  1. ER4x4 T&T means ARY Solutions Ltd (trading as East Rand 4×4 Training and Tours), registered in South Africa.
  2. “the client” refers to the person/s named on the booking form (either provisional or confirmed) and who contacts with ER4x4 T&T on these terms and conditions. The client shall also include anyone who makes a booking for a third party in respect of the booking.
  3. “services” refers to the provision of accommodation, booking of tours, campsite reservations, park entry fees.

Quotations, payments and currency fluctuations

  1. Although ER4x4 T&T makes all reasonable efforts to ensure that the prices on the Website and other marketing materials are correct, it cannot guarantee that the Website and/or marketing materials are free of pricing-errors.
  2. All quotations given by ER4x4 T&T in connection with services to a client shall be in writing (email / WhatsApp) and in the currency of South African Rand. Acceptance of such quotation shall be in the form of signing and submitting the booking form for the required tour (email, or paper).
  3. ER4x4 T&T reserves the right to amend and increase any quotation, even after acceptance by the client in the event of any adverse currency fluctuations, increases in Government or Statutory levies, increases levied by third parties (such as providers of accommodation, camp fees and other third party suppliers) in respect of the services.
  4. Any revision in quotes will be commensurate with the change in currency exchanges or increase in the amounts payable.
  5. All payments to be made by the client to ER4x4 T&T shall be free of exchange, deduction or set-off or whatsoever nature. Payments shall be made by the client to ER4x4 T&T by way of electronic transfer and the client shall provide written proof thereof. The relevant reference number shall be reflected on the proof of payment.
  6. All payments due by the client shall be made by no later than xx days after confirmation of a booking by the client.

Items not included in booking

  1. Certain items are not included in the cost of the booking. These costs are the responsibility of the client including, but not limited to the costs of insurances, fuel, repatriation costs, medical expenses, emergency evacuation, gratuities, beverages and any meals, outings not reflected on the booking reservation.

Booking procedure

  1. In order to secure a provisional booking for the services required, the client shall complete in writing the booking form, and pay ER4x4 T&T a non-refundable deposit of 50% of the quoted cost for the service.
  2. In the event of the deposit not being paid, the provisional booking will lapse.
  3. The balance of payment will be due no later than 30 days prior to set departure rate. Upon receipt of this balance, the booking will be confirmed.
  4. ER4x4 T&T reserves the right to accept or reject any bookings without giving reasons. In this instance ER4x4 T&T will refund any monies paid.

Cancellations and refunds

  1. All refunds are subject to costs of hotel, campsite, game park booking fees already paid by ER4x4 T&T and a 10% administrative fee.
  2. The client may transfer their booking, deposit, confirmation to a substitute, in writing to ER4x4 T&T. Upon acceptance of transfer, it is the client’s responsibility to ensure reimbursement of monies from said substitute.
  3. Cancellations of confirmed bookings may only take place according to the procedure outlined below. All requests for cancellation must be made in writing to ER4x4 T&T and will only be effective on the date of actual receipt by ER4x4 T&T.
  4. Cancellations:
    * 60 or more days notice- 75% (see 1. above)
    * 40 – 59 days notice – 50% (see 1. above)
    * 30 – 39 days notice – 25% (see 1. above)
    * 29 days or less notice – no refunds

Alterations to itinerary

  1. Should there not be enough bookings to justify a tour, ER4x4 T&T reserves the right cancel the tour and either refund the clients deposit, or suggest alternate tour dates.
  2. ER4x4 T&T has the right, at any time, and its sole discretion, to amend or cancel any of the services, or remainder thereof, or to make any alterations in route, accommodation arrangements in the event of the services, or part thereof, rendered impossible, illegal or inadvisable due to force majeure (the definition of which includes war, strike, civil strife, riot, industrial dispute, natural or nuclear disaster, fire, adverse weather conditions, governmental interference) or any other external circumstances beyond ER4x4 T&T’s control
  3. Any extra costs and expenses occasioned as a result of an alteration to or cancellation of itineraries provided in 1 and 2 above, shall be payable by the client on demand of ER4x4 T&T.
  4. ER4x4 T&T may further, at its sole discretion, cancel or terminate the client’s booking for the services, or remaining part thereof, in the event of any illness or the illegal or incompatible behaviour of the client, who in those circumstances, will not be entitled to any refund.

Insurance

  1. The client shall be responsible for arranging and affecting adequate insurance cover to ensure that he carries comprehensive travel and medical insurance cover in order to cover himself, his dependents and/or travelling companions for the duration of the tour.
  2. Under no circumstances shall ER4x4 T&T, its representatives, employees or members be responsible for any costs, losses or damages incurred or suffered by the client, his dependents or travelling companions.

Vaccinations and health

  1. It is the client’s responsibility to be aware of malaria, yellow fever and other potential diseases when travelling. The client must take all necessary vaccinations and precautions, as are required in the prevention of such diseases.

Passports, visas, medical requirements

  1. The client shall ensure that prior to embarking on the travel, his passport and visas, and those of his dependents and travelling companions are valid for the countries to be visited. Such responsibilities shall also extend to vaccinations and other medical certificates and all other travel documents.
  2. ER4x4 T&T does not accept responsibility for changes in medical requirements or regulations for visas or any particular visa requirements. Should the client be refused entry to any country, ER4x4 T&T shall not be liable for any costs of whatsoever nature, and the client will not be entitled to any refund.

Disclaimer of liability

  1. ER4x4 T&T shall not be liable to the client for any claim of whatsoever nature in connection with the provision of the services (whether in contract or delict) and whether for damages for personal injury or to property, howsoever arising, including but not limited to:
    * Any negligent act or omission or statement by ER4x4 T&T, its employees or members.
    * Any grossly negligent act or omission or statement by ER4x4 T&T, its employees or members.
  2. Unless such claim arises from the wilful misconduct of ER4x4 T&T, its employees or members.

Consent to risks assumed

  1. The client consents to the risks inherent in wildlife adventure travel and warrants that he is aware of such risks and undertakes the tours, safaris, wildlife and other excursions in connection with the services with full knowledge and appreciation thereof and at his own risk.

Child policy

  1. A child of 12 years and older will automatically be regarded as an adult and charged as such for all services provided unless otherwise agreed in writing by ER4x4 T&T.
  2. Certain suppliers offer a discounted rate to children under 12 years old, and these rates will be advised according to the itinerary requested at the time of booking.
  3. Certain campsites, reserves refuse permission to children under the age of 12 and as such ER4x4 T&T are obliged to adhere to their requirements. This limitation will be advised on the itinerary.

Obligations of client while on tour

  1. The client undertakes to behave considerately and respectfully while on tour, and undertakes to exercise proper authority over any minor children.
